After an irrigation pipe owned by their homeowners’ association ruptured and flooded the home, a family faces a bill of over $80,000.
The couple’s insurance will not cover damage caused by an external source. However, the HOA’s insurance found that they were not liable as there was no evidence of negligence. The couple now has to clean up all the mess.
“Get up! Roseann Martin remembers Richard Martin telling her that their house was flooding. On July 9, Roseann Martin woke to those words.
Richard discovered that the water in the basement of his Castle Pines Village house was coming up from outside.
Richard said, “It’s just so much. It was like a river.”
The community’s main water irrigation system, of which the homeowners were unaware was only ten feet away, burst and filled their window wells, shattering windows in their spare bedroom, as a result.
Roseann said, “There was an air current and large shards were fluttering through the bedroom.”
It was only after the flooding spread that their basement suffered damage.
After two months, the home still looks torn apart, with contractors working constantly on the basement.
Richard said, “Sucking water from the basement, cutting out the carpet, cutting out the drywall, and ripping out the pad.”
The Martins’ belongings were mostly lost on this level, including antiques and other family items.
Roseann said that the financial losses are life-changing.
Their insurance will not cover the cost.
Richard said, “They told me it was surface water coming from an outside source.”
The couple claims that the HOA, which owns the damaged irrigation pipe, will not help them despite their repeated requests.
We would love to see someone take responsibility and step forward. Richard said, “It wasn’t we.”
The HOA refused to comment. The Martin’s showed CBS Colorado a denial letter that they had received from HOA’s insurer, stating there was no proof of HOA negligence as the pipe wasn’t beyond its lifespan.
The Martins are worried that this disaster might happen again now that they know the pipe is close to their house. They have redone their landscaping and raised the window wells by 15 inches.
